The total-THC definition comes from Section 781 of P.L. 119-37, signed November 12, 2025. H.R. 6500, signed September 2, 2026, split the dates. Only cannabinoids the plant cannot naturally produce stayed on November 12. THCA, and plant cannabinoids converted outside the plant such as delta-8, moved to December 11 (H.R. 6500, Sec. 2019; CRS IF13136; Akerman, September 2, 2026).
Until December 11, the hemp-retail lane depends on the state. Some states test by delta-9 and allow flower. Others already apply total-THC math or ban hemp flower, and there Cereal Milk is lawfully sold only in the licensed-dispensary lane, if the state has one. Being sold in a licensed dispensary does not make a strain legal hemp anywhere.
