In a closed state, “not sold as hemp” does not always mean “not sold”. Where adult-use cannabis is legal, licensed dispensaries sell the same strain names under state law.
The federal hemp lane for high-THCA flower closes on December 11, 2026. Section 781 of P.L. 119-37, signed November 12, 2025, counts THCA in total THC at 0.3% dry weight. H.R. 6500, signed September 2, 2026, set December 11 as the date for everything except cannabinoids the plant cannot naturally produce. After that date, an open state hemp law cannot make high-THCA flower federal hemp.
