What changes for Donny Burger THCA flower on December 11, 2026?
As of October 22, 2026, federal law defines hemp by delta-9 THC: 0.3% or less on a dry-weight basis (7 U.S.C. 1639o). High-THCA Donny Burger can be sold as hemp on that basis, but only where state law allows it.
Section 781 of P.L. 119-37, approved November 12, 2025, rewrites the definition. Hemp becomes plant material with a total THC concentration, “including tetrahydrocannabinolic acid”, of 0.3% or less on a dry-weight basis. Sec. 2019 of H.R. 6500 applies that change, until December 11, 2026, only to products containing cannabinoids a cannabis plant cannot naturally produce.
