As of October 3, 2026, federal hemp is defined at 0.3% delta-9 THC “on a dry weight basis” (7 U.S.C. 1639o; USDA defines the term in 7 CFR 990.1). Some labs report flower “as received”, which includes the water still in the bud. The conversion is: dry-weight result = as-received result / (1 − moisture fraction).

At that point a 27% THCA Jealousy Batch is about 80 times over on any basis, and only licensed dispensaries in states that allow it can sell it, as marijuana.
