When Section 781 takes effect, the gap closes. A Permanent Marker Batch at 24.8% THCA counts as about 21.9% total THC, roughly 73 times the limit. The licensed-dispensary lane does not change: in adult-use states, licensed retailers keep selling Permanent Marker as marijuana under state law. Until December 11, state law still decides where the hemp lane is open. Several states closed it to flower before the federal date.
